Like many emerging economies, Indonesia practices self assessment income tax structure where tax residents have to pay tax based on their global income. This means that they are subject to tax regardless of whether they earn their income within the country. The main taxes are those imposed by the federal government that include income tax, value added taxes, property tax imposed on real estate and buildings and others.

There are also taxation imposed on a smaller scale which are regional that include taxes which need to be paid for development, household, media and such. For businesses, it is essential to know about export tax, import duty, taxation for products like tobacco, sugar, alcohol and other items. Taxation in Indonesia applies to both resident and non-resident income earners as long as it is received in the country. For individuals, the tax rates are from 5% to 30% while those earning below Rp15.000.000 are not taxed. Corporate tax rates are imposed for businesses that record income of more than Rp50b annually with a 25% as at 2010 which is considered to be one of the lowest in the world. For companies whose income is less than the amount will be taxed 12.5% as at 2010.

For foreign companies, there are various options when it comes to setting up your businesses in Indonesia. A representative office would be the easiest and simplest to set up. This is where it is cheaper and definitely quicker to set up as compared to other configurations. Basically, a representative office or RO has a narrow set of activities as compared to a full fledge company. Basically ROs act as the eyes and years for the local market representing the head office which are in another country.

On a larger scale, an RRO or Regional Representative Office has more operational activities. The license is issued by the Investment Coordinating Board of Indonesia where they are only allowed to employ up to 2 expatriates. Major activities here include monitoring and coordinating activities for a region which means that the RRO in Jakarta could be the managing arm for Indonesia, Malaysia, Singapore and the Philippines.

A Foreign Joint Venture company where it can start with total foreign ownership in the start but the regulations in Indonesia is that the company must sell shares to Indonesian investors within 15 years of operations which can be done either going through the stock exchange or through direct placement.

According to the rating in the World Bank’s Doing Business study, Indonesia is considered to be moderate when it comes to starting a business. In the 183 economies the World Bank evaluated, Indonesia is ranked at 122 which is the bottom 100 of the list. In terms of starting a business, it is at number 161 which means that it is quite hard in terms of application and such. This is due to the time taken and the steps involved in registration of businesses.

In terms of employing workers for your company, it is at number 149 while registering property is easier which is at 95. You will most likely be required to bring your own capital as it is not easy to apply for credit from the financial institutions in the country where it is 113 hardest as compared to the 184 economies. Taxation is at 116 while in terms of enforcing contracts, it is at number 146. Hence, from the rankings above, you can comprehend that there are many issues involved with starting a company in Indonesia which would take time and surely money. So it would be advisable to inject your own capital into the company and to be somewhat sure of who you are dealing with before setting up your business there.

First of all, you have to understand the Indonesian culture and people. It will be very helpful if you understand or speak some of the language as it would be a useful tool in any business dealings. Never go into the market cold turkey and get a feel of the market before doing anything. If you have doubts, put your plans on hold. It is always better to take a step back instead of pushing forward blindly, after all it is a foreign country you are embarking your business into. So better be sure.

If you know someone who is helping you in the setting up of the business who is a local, always take good care of them. Always ensure that they are happy to help you and do not be bossy as it would be very counter-productive. Wherever possible, always go direct into the processes. This include applying for registration and particularly dealing with government agencies. Nothing happens overnight, so you must give some time for the application to process. Approvals and such would need time and in Indonesia, there would be some bureaucracy involved so be prepared to wait a while. Pushing for immediate answers will not help.

Starting a business is easy, it is only in the starting of businesses in a foreign country which could sometimes be quite a challenge. So if you are planning to set up an operation in Indonesia, there are some things which you must seriously consider before heading out to the country so that you will not waste too much time on the procedures and any processes which might be time consuming.

First of all, you must learn about the country. There are many ways to learn about the country. If you have a chance to stay there for a while, make sure you do. The longer you stay, the better it is so that you will be able to grasp the local lifestyle there. This is where you must understand the culture, the weather, the language and how businesses are operated there. The best way to start a business is to first form a partnership with a local company. It will be very easy if you know someone there as doing business involves money. Once you have established a foothold among the local market, then you would be able to go out on your own. Otherwise, it is better to contact the government agency to learn about the proper procedures. Remember, there are no short-cuts here.

Playboy Indonesia editor Erwin Arnada has been acquitted by the Indonesian Supreme Court. His crime? Erwin was convicted of distributing and profiting from indecent pictures but everything is now water under the bridge and he is now a free man.

According to Erwin’s lawyer, they have not received a copy of the decision form the court, however the verdict has already been issued by the Supreme Court. Erwin has been in the Cipinang Penitentiary located in East Jakarta since last year of October. He will most probably be released in the morning during normal business hours where the prosecutors will coordinate with the prison regarding the release of Erwin.

Chief Justice Harifin A. Tumpa made the ruling where the 2009 verdict was overturned based one the new evidence that was admitted for judicial review. In his ruling, Chief Justice Harifin A. Tumpa stated that the Supreme Court will acquit the convict of the charges leveled by the prosecutor.

Playboy Indonesia does not feature any nudity in its publication, only bikini-clad women and . However that has not prevented the publication from being the target of vandalism especially by the hard line Islamic group such as the Isam Defenders Front (FPI). The previous trial, however angered free speech activists and Indonesia’s Press Council as the magazine did not violate media laws or contain pornography.
